STATE OF WEST VIRGINIA WEST VIRGINIA REAL ESTATE COMMISSION
Created under Chapter 47, Acts of the Legislature, 1937; consists of three members appointed by Governor, by and with the advice and consent of the Senate; bipartisan; term, four years, two members shall have been residents and citizens of the state for six years prior to appointment and engaged in real estate work for ten years, and the third member shall represent the general public; chairman designated by Governor; secretary selected by commission from among own members; receive same daily compensation as is paid to members of Legislature for interim duties, and reimbursed for expenses incurred; commission to supervise and regulate the business of buying and selling of real estate and to have charge of issuance and revocation of licenses of real estate brokers.

Attach legible copies of contracts and all other documents relating to your complaint. DO NOT use a "Highliter" on any of the documents you submit with your complaint due to the fact these marks do not copy well. Please use black ink when completing the form since numerous copies will need to be produced. You should provide all information which you know or can discover with reasonable investigation. If you wish to file affidavits from persons who have personal knowledge of the facts and circumstances involved in the complaint, the affidavits must be verified before a Notary Public in order to be admissible.
The Real Estate Commission regulates real estate brokers, associate brokers, and salespersons only. The Commission has no jurisdiction over appraisers, banks, mortgage companies, lawyers, engineers, contractors, surveyors, home inspectors, or any other person or company not licensed by the Real Estate Commission. The Commission is not empowered to enforce, interpret, modify, rescind or cancel listing agreements, purchase and sale agreements or any other contract, or to order the return of earnest money, award damages, settle real estate commission fee disputes or otherwise settle claims. If a licensee is found guilty of a violation of the Real Estate License Law or Legislative Rules, the Commission has the authority to take disciplinary action against that licensee. The Real Estate Commission cannot provide private legal advice or services. Please note the following guidelines:
The monthly examination is held in the Charleston Civic Center.
Bring three or four sharpened soft-lead (No. 2 or HB) pencils or mechanical pencils and a good eraser. Pencils and erasers will not be provided at the test site.
You may bring a calculator. You may not use a recording calculator.
You may not leave the room except with the proctor's permission.
Your examination may be canceled if:
1. You refer to notes or other materials;
2. You attempt to remove test materials or notes from the examination room;
3. You attempt to take the test for someone else; and\or
4. You fail to follow all instructions.
At the conclusion of the test, you will be required to return the test booklet, answer sheet, and scratch paper to the proctor. Parking is available in the Charleston Civic Center Parking Building. There is a $3.00 charge for parking in the parking building. To avoid cancellation of your application, please be sure to appear for the examination on the date listed scheduled. Applications are only considered current for a six month period.
